Civil Formal
($10,000 limit)

A formal civil action begins with the filing of a complaint and summons in the Justice Court by an attorney representing the plaintiff in the action. Monetary recovery is limited to $10,000.00. A filing fee, based on the amount sued for, is due at the time the complaint is filed. The plaintiff determines by what method the complaint and summons will be served on the defendant. The plaintiff also provides "Proof of Service" to the Court.

The defendant has 20 days, not counting the date of service, to file a written answer in the Justice Court unless a "Motion Shortening Time to Answer" has been granted. The defendant's answer must then be filed within the time specified. Be prepared to pay a filing fee when filing an answer in the Court.

As a formal civil case is governed by the Justice Court Rules of Civil Procedure, the defendant is strongly advised to consult with an attorney. The Justice Court Clerks cannot give legal advice, and there are no forms available to assist you. Attorney fees are awarded to the prevailing party.

Failure to reply within the time allowed may result in a default judgment against the defendant. If you agree you owe the money, you may contact the plaintiff's attorney directly to try to arrange payment(s).
