Protection Order applications are available on our Forms Page and at the the Virginia Township Justice Court, Monday through Friday, between the hours of 8:00 a.m. to 5:00 p.m.  Law enforcement may contact the judge after business hours for emergency orders.

If you need assistance with completing the application or you have questions about victim resources, please contact the Storey County Victims Advocate Unit. Court Clerks are available to answer procedural questions.  It is against the law, however, for Court staff to give you legal advice.

The judge will review the application. If the statutory requirements have been met, an Order will issue.  The matter may also be set for a hearing.

There are several types of protection orders:

ORDERS FOR PROTECTION AGAINST DOMESTIC VIOLENCE can only be granted for people who have a relationship described in NRS 33.018 (spouses, former spouses, related by blood or marriage, prior or current dating relationship, have a child in common, the minor child of any of those persons, or his/her minor child, or any person who has been a guardian or custodian of a minor child of the adverse party). These types of orders do not require any type of conviction for domestic violence to be granted.  There are many types of acts that fall within domestic violence that can merit issuing of a protective order.

STALKING AND HARASSMENT PROTECTION ORDERS may be issued against someone who has willfully or maliciously engaged in a course of conduct that would cause a reasonable person to feel terrorized, frightened, intimidated, or harassed, and/or that actually causes the victim to feel terrorized, frightened, intimidated, or harassed, regardless of the relationship between the applicant and adverse party.

An Order Against Sexual Assault may be requested when a person reasonably believes that he or she has been a victim of sexual assault.  An adverse party does not have to be convicted of sexual assault to have an order issued against him/her.

A Protection Order Against Harm to a Minor Child may be requested on behalf of a minor child by the child's guardian or parent.  The adverse party (the person from whom the parent is wanting protection) must be 18 years of age or older.

Protection Order Against Harassment in the Workplace.  Only an employer of a business or the authorized agent for that business may apply for this type of order.  If you are an employee being harassed in the workplace, your employer must apply for this type of protection order, or you must file for a different type of protection order on your own behalf.

Emergency Order for Protection Against High-Risk Behavior.  You must be a family or household member or law enforcement to apply for this type of order.  Applications are available at our office.
